Supreme Court: Lawyers Not Subject to Consumer Protection Act.

On May 14, the Supreme Court made a big decision. SC said that lawyers aren’t liable to follow the Consumer Protection Act like regular businesses do. This means if people have a problem with a lawyer’s service, they can’t use this law to complain.

This new decision changes a ruling from 2007 by the National Consumer Disputes Redressal Commission. Before, they said that legal services were covered by the Consumer Protection Act. But now, the Supreme Court says that’s not true anymore.

The judges pointed out something important about the bond between a lawyer and their client. They said that clients have a lot of say in what their lawyer does, even down to not agreeing to anything without saying so. Because of this, the court said that the job of being a lawyer is different from other jobs.

The court also pointed out how special the legal profession is. SC said it’s in a class of its own, called “sui generis / unique “. Judges stressed that the bond between a lawyer and their client is mostly controlled by a personal agreement, not like other services covered by the Consumer Protection Act.
