On January 2023, a person placed prepaid order for an ice cream worth ₹. 187/- using food delivery app Swiggy. The order status showed that the package was collected by the delivery partner from the store but it didn’t reach the customer on time notified on the app. For that reason when the customer later on after few minutes checked the app for the update of order, surprisingly the product status showed delivered. Because the order didn’t get delivered to the concerned person, the customer contacted the Aggregator for the same. Negligence on their part led the customer suffer for the said issue. Hence the customer decided to file a case against this matter, in spite of paying ₹.187 for the order they received no delivery nor the amount was refunded. Swiggy argued that it acted as intermediary between customer and third party by denying to take the responsibility of alleged delivery partner.
Deeming it UNFAIR TRADE PRACTICE the Court directed Swiggy to pay a total compensation amount of ₹.5000/- to the Customer. The Court further stated that there was a deficiency of service on part of Swiggy.
